Terms and Conditions

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which requires publishing the rules and regulations, Privacy Policy, and Terms of Use for access to or usage of the Delivery Star website (https://mydeliverystar.com) and the Delivery Star mobile application ("App").
For the purpose of these Terms of Use, wherever the context so requires, "You" or "User" shall mean any natural or legal person who uses our platform. The terms "We", "Us", "Our" shall mean Delivery Star ("Delivery Star").
1. General Conditions
1.1 By agreeing to these Terms of Service, You represent that you are at least 18 (eighteen) years of age. You may not use our products or services for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.
1.2 We reserve the right to refuse service to anyone for any reason at any time.
1.3 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
2. Modifications to the Service and Prices
2.1 Prices for products and services listed on the App are set by the respective restaurant partners and are subject to change without notice.
2.2 We reserve the right at any time to modify, suspend, or discontinue the Service (or any part of it) without notice.
2.3 Delivery charges may vary based on distance, location, weather conditions, and demand, and will be displayed before you confirm your order.
3. Products and Services
3.1 Food items and other products are offered by independent restaurant partners listed on the App. Availability, quality, packaging, and preparation of items are the responsibility of the respective restaurant partner.
3.2 We make reasonable efforts to display item details, prices, and images accurately; however, minor variations may occur.
4. Account Registration
4.1 To place orders, you must register using a valid mobile number and verify it through a One-Time Password (OTP).
4.2 You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
4.3 You agree to provide accurate, current, and complete information during registration and to keep it updated.
5. Orders and Acceptance
5.1 When you place an order, it is offered to the selected restaurant partner. An order is confirmed only after the restaurant partner accepts it.
5.2 We reserve the right to cancel or refuse any order in cases such as restaurant unavailability, item unavailability, incorrect pricing, delivery area limitations, or suspected fraudulent activity.
6. Payments
6.1 You may pay for your orders using Cash on Delivery (COD) or online payment through our payment partner, Razorpay.
6.2 For online payments, your payment information is processed securely by Razorpay. We do not store your full card details, UPI PIN, or net banking credentials.
6.3 In case of any payment deducted without order confirmation, the amount will be automatically refunded to the original payment method as per the payment partners processing timelines.
7. Personal Information
7.1 Your submission of personal information through the App is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
8. Delivery
8.1 Estimated delivery times shown on the App are indicative and may vary due to traffic, weather, restaurant preparation time, distance, and delivery partner availability.
8.2 You agree to provide an accurate delivery address and to be available at the provided phone number to coordinate delivery.
9. Cancellation Policy
9.1 You may cancel an order free of charge before the restaurant partner accepts it. Once the restaurant accepts the order and begins preparation, the order cannot be cancelled by you.
9.2 In the unlikely event that an item in your order is unavailable, we or the restaurant partner will contact you on the phone number provided at the time of placing the order, and you may choose a substitute, partial order, or cancellation.
9.3 We reserve the right to cancel an order after acceptance in exceptional circumstances (such as restaurant closure or item unavailability), in which case any amount paid online will be refunded.
10. Refund Policy
10.1 For orders cancelled before restaurant acceptance, any amount paid online will be refunded in full.
10.2 For orders cancelled by us or the restaurant after online payment, the paid amount will be refunded to your original payment method.
10.3 Refunds are processed through our payment partner, Razorpay, and are typically credited within 5 to 7 business days, depending on your bank or payment provider.
10.4 Cash on Delivery orders that are not paid do not involve any refund.
11. User Conduct
11.1 You agree not to misuse the Service, place fraudulent or fake orders, abuse delivery or restaurant partners, or engage in any activity that disrupts the platform.
11.2 We reserve the right to suspend or block accounts found to be in violation of these Terms.
12. Disclaimer of Warranties; Limitation of Liability
12.1 We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.
12.2 Delivery Star acts as a technology platform connecting users, restaurant partners, and delivery partners. The responsibility for food quality, hygiene, and preparation rests with the respective restaurant partner.
12.3 To the maximum extent permitted by law, Delivery Star shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.
13. Third-Party Services
13.1 The App integrates third-party services such as payment gateways (Razorpay), maps, SMS providers, and notification services. Their use is governed by their respective terms and policies.
14. Governing Law and Jurisdiction
14.1 These Terms of Service shall be governed by and construed in accordance with the laws of India, and shall be subject to the exclusive jurisdiction of the courts in Karur, Tamil Nadu.
15. Grievance Redressal
15.1 In case of any grievance arising from the use of the App, please contact our Grievance Officer by email. Complaints will be acknowledged within 24 hours and redressed within a reasonable time as required under applicable law.

16. General
16.1 We reserve the right to amend these Terms of Use at any time. Updated terms will be posted on the website/App with the latest updated date.
16.2 Continued use of the Service after changes constitutes acceptance of the updated Terms.
